$500,000 Settlement After Patient Suffers Permanent Hand Scarring Due to Negligence
On December 9, 2020, Phelan Petty’s Brielle Hunt secured a $500,000 settlement on behalf of a woman who suffered permanent hand scarring and pain after alleged negligence by a technician.
Case background
The plaintiff alleged that a radiology technician negligently administered high-pressure IV contrast into the back of her hand. The contrast extravasated throughout all of the dorsal soft tissues, causing the plaintiff to need an emergent fasciotomy to the left hand and left dorsal forearm and subsequent surgical debridement and irrigation.
Since the surgery, the plaintiff has suffered from nerve pain, burning, tingling, and limited range of motion. She sustained permanent and disfiguring scars on her hand and forearm from the fasciotomy. The plaintiff alleged that the technician’s administration of contrast was negligent because small caliber distal veins (such as those in the hand) are fragile. High pressure contrast subjects these veins to great hemodynamic stress, resulting in focal breakage of the vein wall and extravasation of the contrast into the surrounding tissue. The plaintiff alleged the standard of care required the tech to use the antecubital fossa for IV access under these circumstances.
The case settled for $500,000 before the disclosure of the plaintiff’s experts.
